FREEDOM OF INFORMATION (“FOIA”) REQUEST
CONCERNING CONGRESSMAN MARK KIRK
Dear Secretary Gates:
I am writing to request the military and military congressional files and records concerning Congressman Mark Kirk.
Let me begin by thanking you for your great service to the American people. I had the privilege of meeting you when you were Director of the CIA and I thought you were impressive then. I think you are guiding our forces exceptionally well during a difficult period in our military history.
Because of the sensitivity of a FOIA request directed at DOD concerning the military records of a member of congress, who is also my opponent in a primary election campaign for a United States Senate nomination, I felt that out of an abundance of caution this FOIA request should formally be directed to your attention.
In my opinion, Kirk’s military records fall into two classifications:
First, there are records which are “personal” to Congressman Kirk, which may be subject to FOIA or Privacy Act exclusions. (To avoid any confusion about secrecy, I have asked Congressman Kirk to waive any such defenses to disclosure; see enclosed letter.)
Second, DOD maintains congressional liaison files concerning contacts with and actions of members of congress. Thus, and in particular, when Congressman Kirk was on active duty in Afghanistan earlier this year, and apparently late last year, DOD’s congressional liaison officers would have routinely arranged, monitored, supervised and reported on his activities.
Because these files are DOD records and relate to service by a member of congress, I do not believe there are any FOIA or Privacy Act defenses to release of the congressional liaison materials.
Likewise, while Congressman Kirk was in Afghanistan his whereabouts, security and activity were under constant surveillance by the local commander and regional commander’s staff. These records are included in my FOIA request (although they may also be consolidated as part of the congressional liaison files) and, once again, I do not believe any privileges exist to bar immediate disclosure of such DOD files.
I do not know whether Congressman Kirk will seek to obstruct release of the foregoing files. Obviously, the processing of my FOIA request should proceed promptly while we await Kirk’s response to my request to him for a FOIA/PA waiver.
Because much of the FOIA material I am requesting arises in 2008-2009 (e.g., Kirk’s Afghanistan service) I would ask that these materials be disclosed expeditiously and on a piecemeal basis as the files become available.
I do not believe you should await a review of files for which there may be a privilege against disclosure, to delay expeditiously releasing the files for which there is no reasonable basis to bar disclosure, such as the independent military command and congressional liaison materials (see above).
Time is of the essence. Some of Kirk’s older records going back 20 years may take longer to produce; production may be disputed by Congressman Kirk. I do not believe there can be any dispute, however, as to prompt disclosure of military commander/command files and congressional liaison files concerning Congressman Kirk.

By this letter, I am responding to you as well as resubmitting my original FOIA request to the Chief of Naval Operations, USAF, CMC and U. S. Central Command per your e-mail of August 10th. I am also attaching a copy of my original FOIA request, which is incorporated by reference in this request to CNO, USAF, CMC and CENTCOM. I am assuming they will process my FOIA request as you have suggested (original FOIA request attached and incorporated by reference).
Do you have fax numbers or e-mail addresses for the Navy Department, USAF, CMS and CENTCOM? If so, I would appreciate it if you would provide them to me so I may expedite my request to those subdivisions of DOD with a fax or e-mail.
Here are my responses to the specific questions you provided:
1. Scope of Search – DOD vs. CNO vs. USAF vs. CMC vs. CENTCOM
While your DOD search may be limited to nine years, the CNO and Marine Corps FOIA searches would have to extend to the time Mr. Kirk has served in the Navy, or approximately 20 years. Unlike the USAF, CENTCOM or DOD, Navy/CMC records clearly go back further to his original date of service.
Your letter did not mention any offices which are run by DOD for congressional liaison. Does your research include a search of these records as well?
2. Cost of FOIA searches (all agencies listed above)
a. Request for FOIA cost waiver
Mr. Kirk is a candidate for United states Senator. He has prominently and repeatedly claimed his military service as a basis for his election. He has repeatedly staged brief periods of “activation” and used these “activations” to promote his political activity.
Last week Kirk was involved in a political fracas (in which I had no role and only learned about from the media, but whose disclosure is clearly encompassed within my FOIA request) for abusing secrecy at the Pentagon, apparently during another “activation.” I believe a public interest FOIA waiver is therefore fully applicable to any search costs at any and all of the above agencies.
b. Agreement to pay costs
Your request that I agree to an amount in advance that I am willing to pay to obtain FOIA access contradicts my understanding of how FOIA works. My understanding, based on decades of my own FOIA litigation and searches, is that you provide a preliminary estimate of the cost of the file search, and I can then elect to proceed. By asking me what I can afford to pay in advance, you are essentially putting the cart before the horse.
We are dealing here with important public records concerning a candidate for the U. S. Senate, who claims to be the "only congressman mobilized in harm's way since World war II." Therefore, the Navy Department, USAF, Marine Corps, CENTCOM and DOD have de facto become a part of Kirk’s campaign by virtue of his actions, not mine.
I do not expect the FOIA costs to be significant, because the records cannot be that voluminous. Moreover, DOD and its sub-agencies are known for keeping good files on congressional liaison, so the information I seek is clearly encompassed in some master or easily retrievable location(s). I don’t expect you to have to search very hard or very long for files on a sitting congressman who has constantly interfaced with DOD and the additional agencies listed above as recently as last week.
Let’s not be disingenuous about this FOIA request.
Please provide preliminary estimates of the cost. This is directed at all of the above agencies.
3. Presidential directive
My understanding is that President Obama has tasked all executive departments, including CNO, USAF, Marine Corps, CENTCOM and DOD with expansive, expeditious and good faith compliance with FOIA. My request is fully compliant with the President’s directive.
4. Time is of the essence
Time is obviously of the essence. I would therefore ask that all of the above agencies proceed expeditiously with this matter.

I will, of course, provide a reciprocal waiver so that you may request my military records and any other files that are declassified and subject to public disclosure.

New York: Andy Martin explains the latest “explosion” in the Mark Kirk military fraud scandal
The Chicago Sun-Times carries a story Thursday about Department of Defense (“DOD”) accusations on December 9, 2009 that Kirk had unlawfully engaged in “partisan political activities.” That accusation was triggered by materials Andy Martin submitted to DOD on August 1, 2009 as part of his Freedom of Information Act filings at DOD. In other words, Martin's complaints to DOD about Kirk’s unlawful activities triggered an investigation that culminated in the Undersecretary’s accusations against Kirk contained in DOD’s December 9, 2009 letter.
Andy Martin continues to be the driving force behind forcing Mark Kirk out of politics. Andy had not previously released his original August 1, 2009 complaints/FOIA demands to DOD which triggered Kirk’s problems with DOD. These letters will be placed on the internet before his June 10th news conference. “I said last week there was more to come about Kirk, and it is still coming,” Martin says. “No one believed me in January. Maybe people are believing now.”

But Kirk knew as early as August 1, 2009 that I was seeking his military records. Between August 1, 2009 and today’s date I have engaged in spirited correspondence with DOD.
“DOD Undersecretary Gail McGinn was obviously aware of my efforts to secure the release of Kirk’s records. I had been tipped off that there was unhappiness within the Pentagon at Kirk’s grandstanding, and was advised to file a FOIA request, which I did.
“Thus, Undersecretary’s McGinn’s accusations of unlawful ‘partisan political activities’ in uniform was triggered by my ongoing comments to DOD
“Mr. Kirk’s statement Wednesday night implicitly acknowledges that within his campaign I am seen as the devil that will not let go. Kirk is obsessed with me. Kirk’s own statement Wednesday evening mentions my radio ads, as he did when he falsely claimed at the Union League Club he had been ‘fighting for [Andy Martin’s] freedom’ in Afghanistan. Kirk knows I have been hounding DOD to tell the truth. I have also filed a DADT complaint against Kirk with the Navy.
“It is unseemly that Kirk now claims his ‘private’ records have been compromised, when he used DOD secrecy to conceal his own criminal activity. Using federal property for political activity is a criminal act. Instead of filing his own FOIA complaint, Kirk should grant the waiver I asked for and direct the release of all of his military records. Kirk has been using federal secrecy laws to cover up his fraudulent activity in uniform.
“The reason the Sun-Times story and the Nitpicker blog entry appear out of context in so far as Undersecretary Gail McGinn’s accusations of unlawful partisan activity by Kirk (all political activity in uniform is unlawful) of December 9, 2009 is because prior to today (June 10th) no one in the media or public knew I had been clandestinely orchestrating DOD investigations against Kirk since August 1, 2009.

(CHICAGO)(June 8, 2010) Mark Kirk’s political career is over. He won’t admit it, and he may limp along for a few more weeks. But as soon as it becomes apparent Kirk is a drag on the entire statewide Republican Party ticket Kirk will be gone. Bill Brady are you listening?
Monday night (June 7th) MSNBC’s Rachel Maddow presented the best (but still incomplete) compilation of Kirk’s shameless military lies and exaggerations. As media and political opponents continue to scour archives for new snippets of video, the Kirk wound will continue to bleed Republican votes all across Illinois.
Up until last week, I would have thought Kirk was the second worst Republican Party military fraud in history. Now I am convinced he is the all-time “king” of Republican Party military liars.
You can’t say I didn’t provide a proper warning that Kirk was a fraud. Here’s what I had to say on July 21, 2009, as Kirk announced he was a candidate (all of this is taken from my blogs on the web, where there is much, much more anti-Kirk truth-telling)(the following is edited):
(CHICAGO)(July 21, 2009) Mark Kirk is a bigger liar than his real hero, Barack Obama. He is a bigger liar than “Slick Willie” Clinton. Neither Kirk nor Obama lied by falsely claiming to be a “combat veteran.”
Mark Kirk dishonors America’s combat veterans by falsely claiming to be one of them.
First, my own military background. I took the oath of enlistment in the U S Air Force Reserve as part of the commissioning program of the ROTC at the University of Illinois. I later received an Honorable Discharge and did not serve on active duty. My serial number was AF16821011. If anyone wants to see my military records, just ask, and I will sign a Freedom of Information waiver so you can ask to see them at the Department of Defense. Unlike Mark Kirk, I have nothing to hide.
I was in Viet-Nam in 1967, 1968 and 1971. Also in Laos, Thailand and Cambodia. As well as Libya, Egypt, Saudi Arabia, Iraq, Hong Kong and other places. In 2003 I spent a good part of the year in Iraq living in Baghdad.
But despite the fact that I have dodged bullets, mortar shells and worse, and that these memories are very vivid, I would never call myself a “combat veteran.” I was not on active duty with a combat MOS.
War is an experience beyond imagination, except, apparently in the fertile imagination of Mark Kirk who falsely claims to have served in “two armies.” Battle is gut-wrenching. Fear numbs the body almost to the point of death. Our men in Afghanistan today are going through experiences that are beyond belief. Mark Kirk dishonors all of them by falsely claiming to be their equal. If Kirk ever showed his face in a real war zone, and bragged about his bogus service in “two armies,” the men would spit on him.
Iraq was no different. Danger was everywhere for men and women in uniform. I lived in Baghdad during the relatively tranquil period in 2003; my intelligence analysis of the coming catastrophe proved prescient. My analysis of how to win, by supporting the surge, ran contrary to Kirk’s vote AGAINST the surge. Some “intelligence officer,” that Kirk. No wonder we were losing until real warriors took control in Iraq.
At the end of the day, I have known fear, in the company of brave men. Kirk has not. His “fighting” in “two armies” is a delusion and fabrication. He is unfit to be a candidate for the U. S. Senate.
Yesterday, in announcing he wanted to be a U. S. Senator, Mark Kirk dishonored every American serving in harm's way today. He dishonored genuine combat veterans who gave their lives, were wounded or felt the aftermath of stress from exposure to life-threatening conditions. Mark Kirk is a despicable political phony.
I was first alerted to Kirk’s imaginary military role by a column in the Rockford Register Star by Chuck Sweeny (well-spotted Chuck), and then saw the reference again in the daily compendium of Democratic Party operative Rich Miller.

I began to dig deeper into the demented mind and imaginary battle record of Field Marshal Mark Kirk, “combat veteran” of “two armies.”
Kirk stated at his announcement yesterday that “We’ve sent three armies to the Middle East and I’ve fought in two of them. As combat veterans, we get to ask…”
Mark Kirk was never “in combat.” He has never “fought” in any “army” and he is not a "combat veteran.”
On the contrary, Kirk has constantly used and abused his military service as a photo op for his own political career.
One of Kirk’s shameless exaggerations is that he is the first congressman to “deploy” to a combat zone since World War II, apparently since that great World War II “combat veteran,” President Lyndon Johnson, who was Kirk’s alleged predecessor in “warfare.” That apparently is the basis of the claim he is a “combat veteran."
Kirk serves in the Navy Reserves. Reservists are a vital component of our national defense. Kirk is not.
Last year Kirk asked the Pentagon to assign him to active duty for a few weeks as part of a publicity campaign for his political career. He was never in a line company or unit; he never had a combat MOS and he was never in harm’s way. He may have been in “Afghanistan” for a few days, but he was not in any more risk of “combat” there than he is in Kenilworth. Kirk was pampered by military handlers every minute that he was in his imaginary “combat zone.”
Congressmen are often invited to review operations in war zones. I saw them in Viet-Nam and I saw them in Iraq. By no means were these congressional excursions “combat experience.” Visiting a war zone briefly does not place them in “combat” or make them “combat veterans.” Maybe John McCain, who is a real combat hero, should have a talk with the man he supposedly endorsed and explain to Kirkie the difference between being in combat and merely being in a war zone.
Mark Kirk is the 2009 equivalent of that great political fraud (and also a Republican) [Senator] “Tail Gunner Joe” McCarthy.
The only place where Mark Kirk is rumored to be a “tail gunner” is in the salons of Washington, DC (more on that Kirk scandal, later).
If Mark Kirk wants to see real combat veterans, not paper maché imposters such as himself, he should visit our military cemeteries in Normandy.

Lots of people serve in the military without being “in combat,” as Kirk falsely claims. Kirk has worn a uniform. But merely wearing a uniform in wartime does not make you a combat veteran. People peel potatoes; they sit in rooms studying intelligence (which appears to be Kirk’s desk-based assignment) and they engage in non-combatant roles in a combat zone.
The distinction between men who serve in battle, and are entitled to be called combat veterans, and military personnel who serve in a war zone but do not engage in combat or carry a combat MOS, is a very serious one for military veterans.
In Viet-Nam, we used to call the military personnel in Saigon “Saigon commandoes” because they claimed to be war heroes, but were actually eating out at fancy restaurants, living in apartments with bar girls and using mamasans to do their laundry. There were no ”Saigon Commandoes” at Khe Sanh or Con Tien.
Throughout history, combat veterans have been exalted because they placed their lives on the line for their nations. Warriors have been honored for risking their lives, not for seeking to promote themselves politically the way Mark Kirk has inflated his military experience. I have known brave warriors, many of them. I still remember the name of the first Fighting Illini who died in Viet-Nam: Bruce Capel. We remember these men to honor their service and sacrifice. Forever.
Mark Kirk is not one of these brave warriors. He is no “combat veteran.” He is a fraud, imposter and disgrace to the Republican Party. Kirk has shamed and demeaned the uniform he wears by using it to propagandize politically.
If there is anything real combat veterans despise, it is a political parasite such as Mark Kirk who inflates his military service.
Bob Hope probably had more combat experience than Mark Kirk.
Mark Kirk owes every genuine combat veteran an apology. He should stop lying abut his military record, the same way he lies about his “wife” and his personal life.
The national media have not yet discovered Kirk’s interview with Chuck Sweeny. Take a look. The link’s in this story. Sweeny’s column is cringe-inducing. Kirk called himself a combat warrior. “In two wars.”
Kirk has contempt for the people of Illinois, and the American people. Until I came along and started digging, and truth-telling, Kirk had been able to fool people such as Sweeny who repeated Kirk’s lies without realizing they were lies.
Kirk’s lies go far beyond “misremembering.”
Until last year, the notorious Senator Joe McCarthy of Wisconsin was the biggest military liar in Republican Party history. McCarthy was elected to the U. S. Senate in 1946 by falsely claiming to be “Tail-Gunner Joe.” He had never been in an air combat unit and was no tail gunner. It was all a lie.
Kirk didn’t just lie a few times, about one false fact, as Connecticut’s Richard Blumenthal did. Kirk lied over and over again, big lies, small lies, endless lies. Years and years of massive lies. Phony TV ads, campaign biographies, official Congressional web sites.
Kirk thought he could fool Rockford’s Sweeney, and he did. But when Sweeny’s column popped up on my radar screen my campaign began detailed research that has now doomed Kirk. The national media and Alexi Giannoulias have all taken my original material and expanded it with their own research.
But no one has yet focused on Sweeny's interview with Kirk.
Rachel Maddow has a partial compilation of Kirk's lies. The clip will probably be on YouTube by today. There is no doubt more to come.
On the day that Kirk “returned from Afghanistan” in January of this year, and held a bogus news event at the Union League Club in downtown Chicago I was verbally attacked by the Chicago Tribune’s creepy Rick Pearson, on the sidewalk outside the Union League Club. If I were Pearson, and I had now been exposed as a mouthpiece for Kirk’s military lies and “misrememberances,” I would commit suicide. Maybe Kirk and Pearson should take each other down. They deserve each other. The Sun-Times is no better.
Read Sweeny’s column and Kirk interview. It still makes me cringe. It will make you cringe. Kirk has a mental illness. No, he isn’t “crazy” in the sense that he doesn’t know what day it is. Kirk is a sick man who has to lie to aggrandize his own self-image. That is a psychiatric disorder. Kirk’s mind is out of control.
He has disgraced the Republican Party.
As for myself, I have a forty-four year record of unparalleled integrity and commitment to public service and fighting corruption in Illinois politics.
I am probably too honest for Illinois politics. Heck, I just told the truth about Mark Kirk. And no one would listen until it was too late. Now every Republican candidate has to suffer. Kirk’s name is at the top of the ticket.
There is much, much more to come in the war against Mark Kirk and his lies. My vacation is almost over. I’ll be home next week, where I will resume my efforts to run the biggest military fraud in Republican Party history out of Illinois politics. Mark Kirk owes every genuine combat veteran an apology. He should stop lying abut his military record, the same way he lies about his “wife” and his personal life.
The national media have not yet discovered Kirk’s interview with Chuck Sweeny. Take a look. The link’s in this story. Sweeny’s column is cringe-inducing. Kirk called himself a combat warrior. “In two wars.”
Kirk has contempt for the people of Illinois, and the American people. Until I came along and started digging, and truth-telling, Kirk had been able to fool people such as Sweeny who repeated Kirk’s lies without realizing they were lies.
Kirk’s lies go far beyond “misremembering.”
Until last year, the notorious Senator Joe McCarthy of Wisconsin was the biggest military liar in Republican Party history. McCarthy was elected to the U. S. Senate in 1946 by falsely claiming to be “Tail-Gunner Joe.” He had never been in an air combat unit and was no tail gunner. It was all a lie.
Kirk didn’t just lie a few times, about one false fact, as Connecticut’s Richard Blumenthal did. Kirk lied over and over again, big lies, small lies, endless lies. Years and years of massive lies. Phony TV ads, campaign biographies, official Congressional web sites.
Kirk thought he could fool Rockford’s Sweeney, and he did. But when Sweeny’s column popped up on my radar screen my campaign began detailed research that has now doomed Kirk. The national media and Alexi Giannoulias have all taken my original material and expanded it with their own research.
But no one has yet focused on Sweeny's interview with Kirk.
Rachel Maddow has a partial compilation of Kirk's lies. The clip will probably be on YouTube by today. There is no doubt more to come.
On the day that Kirk “returned from Afghanistan” in January of this year, and held a bogus news event at the Union League Club in downtown Chicago I was verbally attacked by the Chicago Tribune’s creepy Rick Pearson, on the sidewalk outside the Union League Club. If I were Pearson, and I had now been exposed as a mouthpiece for Kirk’s military lies and “misrememberances,” I would commit suicide. Maybe Kirk and Pearson should take each other down. They deserve each other. The Sun-Times is no better.
Read Sweeny’s column and Kirk interview. It still makes me cringe. It will make you cringe. Kirk has a mental illness. No, he isn’t “crazy” in the sense that he doesn’t know what day it is. Kirk is a sick man who has to lie to aggrandize his own self-image. That is a psychiatric disorder. Kirk’s mind is out of control.
He has disgraced the Republican Party.
As for myself, I have a forty-four year record of unparalleled integrity and commitment to public service and fighting corruption in Illinois politics.
I am probably too honest for Illinois politics. Heck, I just told the truth about Mark Kirk. And no one would listen until it was too late. Now every Republican candidate has to suffer. Kirk’s name is at the top of the ticket.
There is much, much more to come in the war against Mark Kirk and his lies. My vacation is almost over. I’ll be home next week, where I will resume my efforts to run the biggest military fraud in Republican Party history out of Illinois politics. Join me in working to defeat, demolish and politically destroy Mark Kirk. I intend to accomplish my goal with a simple weapon: the truth.
Kirk and the national media have yet to focus on Kirk’s false claim he was a CIA agent. When is that grenade going to explode?

I provided the pointers on both Kirk's sexual misrepresentations and on his inflated military career. I filed a DADT complaint against Kirk. It's all out there on my blogs. Kirk can read it and weep.
“I beat the newspapers at their own game, by telling the truth about Kirk while they were lying to their readers. Lynn Sweet, the Sun-Times hack who appears on MSNBC, was a cheerleader for Kirk; she’s now exposed as a complete loser. Pentagon clamps down on political abuses by Congressman Mark Kirk
Kirk adversary Andy Martin will hold a blockbuster news conference on Memorial Day to disclose that the Department of Defense is prohibiting Mark Kirk from blatant use of military uniforms and insignia in his political campaigns. DOD wants to a void any implication of an “endorsement” of Kirk by the military. “Mark Kirk is the greatest military imposter in recent history,” Martin charges. “Kirk makes Connecticut military fraud Richard Blumenthal look like a genuine ‘war hero.’ Now the Pentagon has had enough.
“Kirk has been told to place a disclaimer on his use of military garb, and cannot use military insignia to falsely portray himself as a Navy warrior. All this has come as a result of my pressuring the Pentagon to shut down the Mark Kirk ‘stolen valor’ political fraud campaign in Illinois,” Martin says.
Martin has been attacking the Department of Defense for allowing military imposter Kirk to sashay around in various uniforms and on military installations, when the obvious intent is to falsely portray Kirk as some sort of warrior in Kirk’s campaigns for office. “Kirk was in Afghanistan this year as a congressman,” Martin says, “looking for photo ops and seeking to mislead the voters. He performed no actual military duties. If he has any evidence to sustain his claims Kirk should sign a waiver and release his complete Navy/military file to the public.
“Kirk is a dangerous fraud artist and imposter. In the past he has also claimed to be a ‘CIA agent.’
“Kirk had the support of the sleazy Illinois Republican Party’s establishment, but he lied to primary voters and obtained a fraudulent nomination. Kirk bribed the Republican Party with $50,000 in cash to rig the primary in his favor. The ‘election’ was a travesty. Cash-and-carry democracy is not democracy at all. It is Washington Beltway corruption and control of our local electoral process. Kirk used the Republican Party’s apparatus as his own campaign machinery. When a primary is rigged, the candidates that emerge from that process are not entitled to party loyalty.
“I am continuing my Freedom of Information activity to seek the release of Kirk’s hidden military files. There is nothing more despicable than a fraud such as Kirk who seeks to inflate his military service and ‘rip off’ the valor of our men and women in uniform for his own political aggrandizement. Kirk is a sick, sick man. Kirk should be criminally prosecuted for his military abuses and falsifications.
“Illinois news media have been Kirk’s accomplices in spreading Kirk’s bogus military claims. In one utterly absurd example in January, Kirk issued a false press release to the Associated Press, which then uncritically reported Kirk’s lies. Kirk then printed the AP’s lies on his own campaign literature, in effect laundering his lies through the Associated Press. This is journalism? I have posted the U. S. Navy’s response to my earlier FOIA request, in which the Navy could find no records to confirm Kirk’s claim that he ‘served’ in Kandahar, Afghanistan in 2008 [see www.markKirk.us and click on letter link].
“In reality and practicality Kirk has been a visiting congressman who tried to collect a second salary by falsely claiming he was doing ‘double duty’ on ‘active duty.’ If you look at Kirk’s May 13th picture, you see no military insignia, rank. He was engaged in a sham episode of ‘deployment’ for his own political advancement, and performed no useful military activity. It is disgraceful that Secretary Gates has allowed the Navy department to be misused in this matter.
“I hope to raise money to run anti-Kirk ads during the summer and fall,” Martin says.

(CHICAGO)(May 31, 2010) Former Republican U. S. Senate candidate Andy Martin will hold a Palm Beach news conference Memorial Day, Monday, May 31st to announce that the Department of Defense has barred Mark Kirk from using military garb to promote his political campaigns.
During the Illinois Primary Martin ran a statewide radio ad disclosing that Kirk was a military fraud who was inflating his resume. The ad can be heard at:

Kirk’s opponent Alexi Giannoulias has now picked up on Martin’s earlier advertising and disclosures. Kirk uses his congressional position to concoct photo ops on military installations to further his political campaigns.

“Kirk was in Afghanistan this year as a congressman,” Martin says, “looking for photo ops and seeking to mislead the voters. He performed no actual military duties. If he has any evidence to sustain his claims Kirk should sign a waiver and release his complete Navy/military file to the public.
“Kirk is a dangerous fraud artist and imposter. In the past he has also claimed to be a ‘CIA agent.’
“Kirk had the support of the sleazy Illinois Republican Party’s establishment, but he lied to primary voters and obtained a fraudulent nomination. Kirk bribed the Republican Party with $50,000 in cash to rig the primary in his favor. The ‘election’ was a travesty. Cash-and-carry democracy is not democracy at all. It is Washington Beltway corruption and control of our local electoral process. Kirk used the Republican Party’s apparatus as his own campaign machinery. When a primary is rigged, the candidates that emerge from that process are not entitled to party loyalty.
“I am continuing my Freedom of Information activity to seek the release of Kirk’s hidden military files. There is nothing more despicable than a fraud such as Kirk who seeks to inflate his military service and ‘rip off’ the valor of our men and women in uniform for his own political aggrandizement. Kirk is a sick, sick man. Kirk should be criminally prosecuted for his military abuses and falsifications.
“Illinois news media have been Kirk’s accomplices in spreading Kirk’s bogus military claims. In one utterly absurd example in January, Kirk issued a false press release to the Associated Press, which then uncritically reported Kirk’s lies. Kirk then printed the AP’s lies on his own campaign literature, in effect laundering his lies through the Associated Press. This is journalism? I have posted the U. S. Navy’s response to my earlier FOIA request, in which the Navy could find no records to confirm Kirk’s claim that he ‘served’ in Kandahar, Afghanistan in 2008 [see www.markKirk.us and click on letter link].
“In reality and practicality Kirk has been a visiting congressman who tried to collect a second salary by falsely claiming he was doing ‘double duty’ on ‘active duty.’ If you look at Kirk’s May 13th picture, you see no military insignia, rank. He was engaged in a sham episode of ‘deployment’ for his own political advancement, and performed no useful military activity. It is disgraceful that Secretary Gates has allowed the Navy department to be misused in this matter.
“I hope to raise money to run anti-Kirk ads during the summer and fall,” Martin says.

Former U. S. Senate candidate Andy Martin says he is working to defeat Mark Kirk for the U. S. Senate. Martin calls Kirk a “fundamentally immoral” individual. (CHICAGO)(April 14, 2010) Former Republican U. S. Senate candidate Andy Martin will hold a Chicago news conference Wednesday, April 14th to announce he is not supporting, and is working to defeat, Mark Kirk for U. S. Senator.

"First, Mark Kirk is a fundamentally immoral individual,” Martin will charge. "He worked to cover-up pedophilia in the U. S House of Representatives and tried to get pedophile Mark Foley to run for reelection. I find Kirk’s behavior sickening.
“Second, I continue to be deeply concerned by the allegations of Republican leaders such as Jack Roeser and Ray True, whose charges about Kirk’s private life are still there to be heard on the internet. The fact that Roeser is now supporting Kirk, while continuing to accuse Kirk on the Internet of possibly being a ‘freak in the sexual department’ involving in ‘pornographic sex,’ says more about Roeser’s confused state of mind than it does about the truth of Roeser’s original accusations.
“Third, Kirk shamelessly lies about and inflates his military record. Kirk’s military falsifications and exaggerations were an issue late in the primary. My advertising attacking Kirk’s abuse of the U.S. Navy uniform was later picked up by a reporter.

“In an ‘endorsement,’ left-wing Sun-Times columnist Neil Steinberg called Kirk a ‘new Dick Durbin’ and Richard Daley’s favorite Republican. Is this what Republicans really want? Another Durbin? A Daley Republican? Is Kirk part of the corrupt bipartisan Combine, or what?

Congress. Voters may have been confused when I called Kirk a ‘de facto’ pedophile. There is no confusion in my mind. He who supports and endorses is just as guilty in the eyes of the law.
“Likewise, Kirk’s sham ‘marriage’ reflected a deeply disturbed psyche. I predict it’s going to be a ‘hot’ summer for Mr. Kirk.
“Bottom line: I am not supporting Kirk. I am working to defeat Mark Kirk. He is a fundamentally immoral individual.
“I plan to support all of the other members of the Illinois Republican ticket. While I may not agree with all of them on every issue, they are within the zone of reasonable accommodation. Kirk is not.
“I hope to raise money to run anti-Kirk ads during the summer and fall.”
