(CHICAGO)(October 22, 2010) A third of a century ago, way back in 1977, I traveled across downstate Illinois and the Chicago region. I predicted at the time that we were exporting our jobs, and that we would eventually be exporting the futures of our children. One of my close friends was Marty Ward, a UAW member who worked in the Farmall division of International Harvester. I had a lot of friends on the shop floors of Illinois’ factories.
I don’t suppose anyone believed that my predictions would come true. I had majored in economic history, and studied industrial declines. Illinois’ manufacturing economy was dying. Fellow Americans would stab each other in the back to save a nickel, so we really didn’t care if our neighbors’ jobs were exported as long as we could scrape up a few pennies in savings.
Today most of Illinois is an industrial wasteland. Downstate cites are hollow remnants of their former manufacturing glory. Chicago is a bankrupt theme park. And America itself is also an industrial wasteland. How did we get there? Well, since I have the credibility of a third of a century of truth-telling, it is time for me to take the Chicago Tribune to task for seeking to protect Mark Kirk from Alexi Giannoulias’ charge of economic treason:

Mark Kirk is guilty of economic treason. He is guilty as sin.
Kirk’s standard response to any accusation is to hide inside his tattered U. S. Navy uniform. Real Navy officers cringe when they see Kirk using the Navy uniform as a political costume. Kirk is the biggest liar in Navy history and a complete disgrace to the uniform. His constant efforts to wrap himself in navy blue should make Illinois voters see red.
I really don’t want to defend Alexi Giannoulias, but Giannoulias’ accusation that Mark Kirk was in the forefront of exporting Illinois jobs to China is true. 100% true.
The Chicago Tribune knows Giannoulias’ accusation could be a lethal one for Kirk (I hope G puts up an ad on this one) and so the Tribune is trying to brand Alexi’s accusations a fantasy. They are not a lie:

Both political parties, of course, are complicit in the destruction of our economy and particularly in the dismemberment of our manufacturing base. Republicans didn’t do it alone, and Democrats get as much of the blame as their opponents. But, on the issue of exporting jobs and keeping profits offshore, as Google is now doing, Republicans have a far worse record than the Democrats.
The Democrats have been kept in check, a little, by their union supporters. There is only so much damage the economic royalists in the Democratic Party can do before unions start to squawk.
But Republicans do not have unions to restrain them, and that is why they have been the real malefactors in exporting our economic future to Asia.
The “economic treason” accusation comes as a result of a leak from the Kirk campaign: Someone, “no one knows who,” has leaked a memo indicating that Kirk was holding a “fundraiser” via teleconference with Americans living in Beijing:

Well, where do you suppose those Americans were working? Rockford? They were working in China, and they were managing the export of Rockford’s jobs, and the Quad Cities’ jobs and Decatur's jobs, to China.
You have to give Kirk, the greedy little critter, credit for being so desperate for every dollar that he vacuumed up cash from people who were also engaged in economic treason: the people he tapped for campaign cash in Beijing.
The Chicago Tribune tries to defend Kirk by applying the literal definition to treason. Well, literally, Kirk betrayed America, betrayed American workers and endangered our economic future. What’s not treason?
Kirk recognizes how lethal Giannoulias’ attack could be, which is why Kirk is debasing his Navy uniform to defend himself.
Let me for a moment play advocate for Giannoulias and plead his case despite my reluctance to do so. I am opposing Kirk, but I am not endorsing Giannoulias. Still, the truth is the truth.
It is almost certain there will be an overwhelming Republican majority in the House of Representatives after November 2nd. There is a very real possibility the Senate could also “go Republican." A 100% Republican congress could become an ongoing disaster for American manufacturing and our economic recovery.
The Kirkster and all of his tens of millions of dollars in campaign contributors would be under the working control of the China lobby. Kirk & Co. would feel no restraint in allowing the continuing export of American jobs, and the continuing destruction of America’s future. Kirk and the Republicans stripped America bare during the early years of the first decade; what will stop them from doing so again? Greed, and only greed, motivates Kirk.
Kirk has always been for sale to the highest bidder and today the highest bidders are fronts for China’s economy.
Ironically, Kirk’s entire life is a continuing series of betrayals. Kirk has committed the ultimate treason, against himself.
If Kirk had maintained an honorable military career he could have campaigned as a good Navy man. But instead Kirk betrayed the Navy and he betrayed his military comrades by constantly lying about his military service.
Kirk betrayed Illinois media who covered up his lies for years, and endorsed him for office right into 2010. As recently as January 2010 Kirk was lying to the media about being “under fire” in Afghanistan, and other imaginary military escapades in his life. Even today, the media still report lies about Kirk’s "service in Afghanistan" and other military misrepresentations that Kirk has papered all across the internet. When I exposed Kirk in January as a military imposter, the media attacked me for telling the truth. A prophet is not without honor.
Kirk betrayed the Republican Party, which he later purchased in 2009 for thirty pieces of silver (now worth $50,000). That is why Kirk is still struggling as a candidate.
Kirk betrayed his wife, a topic on which we will have a blockbuster story in a couple of days.
Kirk betrayed national security, which has been the subject of our current undercover investigation.
Finally, Kirk betrayed homosexuals. Instead of acknowledging his private life, and liberating himself from a life of lies, Kirk brought down the wrath of the gays in June when they rebelled against his efforts to block the repeal of Don’t Ask, Don’t Tell.
Unlike the Republican whacko in Alaska, who handcuffed a reporter, I seriously doubt that Alexi Giannoulias has goons who are going to handcuff Kirk and lead him away to be tried for economic treason.
But the inescapable reality is that Kirk betrayed Illinois, betrayed the Navy and ultimately betrayed himself. If that isn’t treason, what is?

(CHICAGO)(June 30, 2010) Political corruption fighter Andy Martin today filed a federal civil rights lawsuit in the Circuit Court of Sangamon County, Illinois (federal claims may be filed instate courts) seeking to put an end to fraudulent election tactics in Illinois elections.
Martin charges that Mark Kirk is using a “lizard lawyer” to harass Martin’s efforts to defeat Kirk. Also named as defendants are Republican Party stooges Donna and Andrew Heffernan.
Martin’s complaint also sues attorney Andrew Finko and his client Robert Sherman as well as Sharon Meroni. Martin plans to place liens on the property of the Heffernans, Meroni, Fogarty, Finko and Sherman to block any attempts by the defendants to hide assets.
"These individuals are abusing the law," Martin says. “Finko and Sherman filed thirteen (13) election challenges without even examining one petition. Sharon Meroni has manifested unstable mental behavior and filed 32 challenges to candidates, without examining a single petition and without raising a single issue contemplated by the election law. This is abusive behavior which discourages people from running for office.
“My lawsuit also exposes John Fogarty, a Republican Party sleazeball who was once compared to ‘trailer trash’ by a state judge. Fogarty is acting as a secret agent for Kirk, and using the Heffernans as stooges to file Kirk's surreptitious claims. The Heffernans filed eleven (11) election challenges, all of which were perjured. The practice of recruiting ‘straw men’ to file ‘objections’ instigated by undisclosed individuals constitutes common law ‘maintenance’ and is against Illinois law. Neither Finko nor Fogarty have bona fide attorney-client relationships with their so-called ‘clients.’
“I will also be asking the Attorney Registration and Disciplinary Commission (ARDC) to impose sanctions on the attorneys for professional misconduct. Corruption exists in Illinois because regulatory agencies tolerate, and therefore encourage, corruption. It is time to say ‘enough.’
“We will be seeking an injunction hearing very soon,” Martin says. “There are dozens and dozens of candidates who are being abused by these craven individuals. I am standing up on behalf of voters to reform Illinois politics, and to allow citizens to run for office without fearing anonymous attacks from crooked politicians hiding in the shadows.”

Embattled U. S. (CHICAGO)(June 29, 2010) One of the most noxious aspects of Illinois politics is the way access to the ballot is riddled with blatant fraud and corruption. If you want to know why quality candidates avoid running for office in Illinois, having to confront slimy lawyers and shills for secret political bosses at “election boards” is a large part of the problem.
In many states today, a candidate pays a simple “filing fee,” often tied to the salary of the office. The candidate also files a statement of candidacy, and is on the ballot. Not so in Illinois.
Candidates are forced to solicit thousands of meaningless “petitions,” which are signed by persons having no knowledge of the candidate. These “petitions” must then be filed with the State Board of Elections. Corrupt politicians then hire “front men” and women to file “objections” to candidate petitions. The front men perjure themselves by claiming to be interested in the matter, when their interest is entirely fraudulent and solely connected to shielding the real opposition from public scrutiny.
In the case of a federal candidate, these tactics violate federal law.
The current petition period is illustrative. A series of fronts, whose names are below, have filed dozens of “objections” to the petitions of various candidates, including me. These “objectors” have committed perjury and fraud on a state agency.
We are going after these election lizards to force them to disclose who is paying their attorneys, and who is behind the lawyers that use shields to conduct business without disclosing their real clients.
If you have any information about Andrew Heffernan, Sharon Meroni or Robert Sherman, please let us know so we can include it in our lawsuit. We are preparing a lawsuit for filing and we plan to file against the bogus objectors and their attorneys and law firms on June 30th.

Dear Mr./Ms _____:
I am advised that you have filed some sort of attack on my nominating petitions, as well as attacks on a large number of other candidates. You are obviously acting as a “straw person” or "front person” for other persons who are hiding behind you and using your name to file mass attacks on the election process. Your behavior violates federal laws on both mail fraud and civil rights and amounts to a form of political terrorism. Filing numerous attacks against large numbers of candidates, all while acting as a front for unnamed individuals, is a serious law enforcement matter.
You personally never even checked my petitions, so someone put you up to acting as a “front.” I suspect that is also the case with the numerous other objections you submitted.
Tuesday I will be taking the following action:
1. I will be reporting your criminal activity (mass attacks on numerous candidates without personal knowledge of the facts stirred up by unethical attorneys being paid by third parties) to the Federal Bureau of Investigation office in Chicago for investigation as well as the Department of Justice Civil Rights Division. That agency will be asked to open a file on your personal activity.
One of the issues that has bedeviled Illinois politics and led to ongoing criminal prosecutions is situations where people allow their names to be used as a “fronts” to commit unlawful political activity by secret (undisclosed) persons. That appears to be the situation involving you. You personally have no direct knowledge of your own claims and arguments, and have been suborned to commit perjury by an attorney or other persons acting on behalf of undisclosed individuals.
2. I will be filing suit Wednesday in an Illinois circuit court under the federal civil rights and racketeering laws, naming you and any counsel acting on your behalf as a defendant. We will be placing a lien on your real estate to prevent you from transferring assets to avoid a judgment against you. The lien will be recorded against your property as soon as practical.
3. We will also be asking the ARDC to investigate any attorney who is orchestrating your activity.
4. I am going to be asking a county grand jury to open an investigation into your activity against numerous candidates.
The fact that you are acting as a shill for Illinois politicians and allowing your name to be used in a lawsuit at the Board of Elections, against numerous people with whom you have never had any contact or seen any of their petitions, amounts to criminal activity under Illinois law as well.
We are continuing our investigation.
I would urge you to consult with an independent attorney, and not the criminals who are associated with either the Illinois Republican Party or other political operatives who have apparently manipulated you into signing legal documents concerning which you have no personal knowledge.
If you obtain independent legal counsel, please have your independent counsel contact me at his or her earliest convenience so that counsel and I can discuss the claims against you. You should also notify your homeowner’s insurance company, if any, since you may want to invoke the tort litigation provisions for a legal defense of the lawsuit against you.
Filing lawsuits, i.e. election challenges, against candidates for federal office is a federal offence. That is why you need independent counsel and you should not rely on the advice of sleazy lawyers associated with either the Illinois Republican Party or other similar political operations.
Your behavior in attacking numerous candidates is disgraceful and I intend to see that your illegal activity is severely sanctioned by the courts and other law enforcement agencies after you have been afforded due process of law. (CHICAGO)(June 29, 2010) One of the most noxious aspects of Illinois politics is the way access to the ballot is riddled with blatant fraud and corruption. If you want to know why quality candidates avoid running for office in Illinois, having to confront slimy lawyers and shills for secret political bosses at “election boards” is a large part of the problem.
In many states today, a candidate pays a simple “filing fee,” often tied to the salary of the office. The candidate also files a statement of candidacy, and is on the ballot. Not so in Illinois.
Candidates are forced to solicit thousands of meaningless “petitions,” which are signed by persons having no knowledge of the candidate. These “petitions” must then be filed with the State Board of Elections. Corrupt politicians then hire “front men” and women to file “objections” to candidate petitions. The front men perjure themselves by claiming to be interested in the matter, when their interest is entirely fraudulent and solely connected to shielding the real opposition from public scrutiny.
In the case of a federal candidate, these tactics violate federal law.
The current petition period is illustrative. A series of fronts, whose names are below, have filed dozens of “objections” to the petitions of various candidates, including me. These “objectors” have committed perjury and fraud on a state agency.
We are going after these election lizards to force them to disclose who is paying their attorneys, and who is behind the lawyers that use shields to conduct business without disclosing their real clients.
If you have any information about Andrew Heffernan, Sharon Meroni or Robert Sherman, please let us know so we can include it in our lawsuit. We are preparing a lawsuit for filing and we plan to file against the bogus objectors and their attorneys and law firms on June 30th.

Dear Mr./Ms _____:
I am advised that you have filed some sort of attack on my nominating petitions, as well as attacks on a large number of other candidates. You are obviously acting as a “straw person” or "front person” for other persons who are hiding behind you and using your name to file mass attacks on the election process. Your behavior violates federal laws on both mail fraud and civil rights and amounts to a form of political terrorism. Filing numerous attacks against large numbers of candidates, all while acting as a front for unnamed individuals, is a serious law enforcement matter.
You personally never even checked my petitions, so someone put you up to acting as a “front.” I suspect that is also the case with the numerous other objections you submitted.
Tuesday I will be taking the following action:
1. I will be reporting your criminal activity (mass attacks on numerous candidates without personal knowledge of the facts stirred up by unethical attorneys being paid by third parties) to the Federal Bureau of Investigation office in Chicago for investigation as well as the Department of Justice Civil Rights Division. That agency will be asked to open a file on your personal activity.
One of the issues that has bedeviled Illinois politics and led to ongoing criminal prosecutions is situations where people allow their names to be used as a “fronts” to commit unlawful political activity by secret (undisclosed) persons. That appears to be the situation involving you. You personally have no direct knowledge of your own claims and arguments, and have been suborned to commit perjury by an attorney or other persons acting on behalf of undisclosed individuals.
2. I will be filing suit Wednesday in an Illinois circuit court under the federal civil rights and racketeering laws, naming you and any counsel acting on your behalf as a defendant. We will be placing a lien on your real estate to prevent you from transferring assets to avoid a judgment against you. The lien will be recorded against your property as soon as practical.
3. We will also be asking the ARDC to investigate any attorney who is orchestrating your activity.
4. I am going to be asking a county grand jury to open an investigation into your activity against numerous candidates.
The fact that you are acting as a shill for Illinois politicians and allowing your name to be used in a lawsuit at the Board of Elections, against numerous people with whom you have never had any contact or seen any of their petitions, amounts to criminal activity under Illinois law as well.
We are continuing our investigation.
I would urge you to consult with an independent attorney, and not the criminals who are associated with either the Illinois Republican Party or other political operatives who have apparently manipulated you into signing legal documents concerning which you have no personal knowledge.
If you obtain independent legal counsel, please have your independent counsel contact me at his or her earliest convenience so that counsel and I can discuss the claims against you. You should also notify your homeowner’s insurance company, if any, since you may want to invoke the tort litigation provisions for a legal defense of the lawsuit against you.
Filing lawsuits, i.e. election challenges, against candidates for federal office is a federal offence. That is why you need independent counsel and you should not rely on the advice of sleazy lawyers associated with either the Illinois Republican Party or other similar political operations.
Your behavior in attacking numerous candidates is disgraceful and I intend to see that your illegal activity is severely sanctioned by the courts and other law enforcement agencies after you have been afforded due process of law. Why did Mark Kirk run from the media on Monday?

(CHICAGO)(June 22, 2010) Monday morning I finished a column on Mark Kirk and the way his antics are now raising questions in the national media. Afterwards, I headed for lunch and ordered my usual (whole wheat bread, roast beef and Swiss, mayo and mustard, lettuce and tomato). By the time I finished my sandwich Kirk has created another campaign incident.
After speaking to a crowd of 1,000 people, Kirk attempted to flee from the event in downtown Chicago. Kirk was pursued by screaming media calling out his name. Kirk ran through kitchens and back doors, to a waiting SUV that drove off into the traffic.
Weird.
Just about all of Chicago’s media had staked out the MPC event, and all media are reporting on Kirk’s “escape.” The best video is provided by WLS-TV Channel 7:

So what does all this mean? Even I’m starting to get stumped.
Kirk can’t evade the media indefinitely. Up to a month ago, the media were Kirk’s base. People like Charles Thomas and Andy Shaw were his attack dogs. The Chicago Tribune’s editorial board was Kirk’s cheerleading squad.
A month later, Kirk’s personal life is in chaos, his campaign is in a shambles. Kirk’s inflated military career has become a liability and embarrassment. Even Kirk’s “teaching” experience turned out to be illusory. He was even dumped on by his former nursery school.
Kirk has made his bad situation much worse. The word “misremembered” is probably going to be in dictionaries before long.
Why did Kirk run on Monday? How long does he think he can keep escaping from reporters? Beats me.
Later in the afternoon, I got a call from the Pentagon in response to my Freedom of Information (FOIA) request for all of Kirk’s military records. In the coming days the Department of Defense is going to do a “document dump” and sink “Commander Kirk.”
On and on it goes. Who is advising Kirk? With 45 years of experience in Illinois politics I have never seen a worse statewide campaign. The worst thing Kirk could have done Monday was to run, and he ran. Now every event he attends is going to become a “run” until Kirk is caught. Kirk might think he can explain himself to a friendly audience such as the morons at the Tribune editorial board, but there is no assurance even those gullible bozos will want to coddle Kirk any longer (full disclosure: I am not welcome in the Tribune editorial board room).
The Tribune and Sun-Times and all of Chicago’s mainstream media have egg on their face. Rick Pearson, the Tribune’s creepy reporter who accosted me outside the Union League Club in January, will have to go back to hanging around. Maybe he and Kirk can look for a new nursery school together.
Kirk lied for years. He lied about every aspect of his life, even when there was no need to lie. The media did nothing to check out the facts even after I broadcast statewide ads exposing Kirk as a military imposter and I posted an actual document from the Pentagon confirming that accusation. What more did they want for a starting lead? Still, the media slept.
And the jokes keep coming. Everyone has been laughing at Alvin Greene, the South Carolina Democrat who won a primary under questionable circumstances. But we have our own Alvin Greene here in Illinois.
LeAlan Jones is a U. S. Senate candidate who says on his web site he abandoned the “pressurized world of high finance” at JP Morgan Chase Bank to become a Chicago high school football coach. What does he think the U. S. Senate is if not a “pressurized world?” Mr. Jones has no political experience but he is ready to enter the “world” he already rejected. Mr. Jones may not be quite as inarticulate as Alvin Greene but when asked Monday about future planning in the Chicago metro area all Jones could talk about was the ghetto today. Of course, goofy voters elected Barack Obama, so Jones’ lack of seasoning and experience may not be a handicap. Hey, it’s Illinois.
Something crazy and silly is happening in our national life. We have men and women dying in Afghanistan. We have a Gulf that is saturated with muck. But Democrats are attacking BP executives for going sailing, while our own President Obama is off golfing and attending baseball games. Why is it all right for Obama and Biden to play golf, but not all right for British executives to relax?
Obama knows nothing about the military, and nothing about crisis management. It turns out there really is “no drama” in “no drama Obama.” In fact, there’s nothing at all inside Obama, no drama no nuttin’. [Sales pitch: read my book, “Obama: The Man Behind The Mask,” that predicted his meltdown.] Obama is the paper maché president. In a crisis, a commander doesn’t take a vacation every weekend, he or she goes down to the Gulf and takes command.
But Obama’s “Commander-in-Chief” credentials aren’t any more authentic than Mark Kirk’s. And so America and Illinois continue to suffer under the yoke of incompetent and fraudulent leadership.
In the midst of all of this negative energy we have Mark Kirk, who gloats he has “clean” military efficiency reports even though he has been admonished for engaging in political activity while in uniform. Who scrubbed Kirk’s personnel files? There is much, much more to come in the Kirk-Navy scandal.
What’s Kirk’s next escape plan? Hide out with Osama? Lay up in Kandahar until election day? Inshallah.

It was just a year ago that my senate campaign started questioning Mark Kirk’s credibility. We launched a massive research and investigation operation looking into the Kirkster’s past. The result was a blog with actual documents showing U. S. Senate candidate Kirk was a liar about his military service: www.MarkKirk.us. We ran statewide radio commercials exposing Kirk as a fraud:

Even after the primary we kept digging, filing Freedom of Information Act requests. And while local media continue to minimize or ignore Kirk’s lies, national media have become fascinated with Kirk’s lies. In less than a month Kirk has gone from a frontrunner to a joke.
Last week the New York Times demolished Kirk’s “teaching career” and showed his “experience” was nothing but another Kirk fib:

Saturday I held a news conference and disclosed Kirk’s “teaching” in London violated United Kingdom law. He was acting as an “illegal alien.”
And over the weekend Steve Benen, a blogger for Washington Monthly (see above), breached the dam and suggested Kirk’s exaggerations rise to the level of a mental problem. I have not had any contact with Benen, and have no idea who he is. But I have been posting claims for some time that Kirk has a personality disorder.
Now that the issue of Kirk’s sanity has been raised by an out-of-state writer, Kirk is doomed. The implosion of his campaign will be one of the most bizarre stories of the 2010 election campaign cycle. In 45 years of political involvement I have never seen anything like Kirk’s record of lies and delusional claims. People outside Chicago have begun to notice.
My mother used to be a speech teacher at the University of Illinois, and is now a retired speech professor. She always told her students that ridicule is one of the most powerful forms of rhetoric. Kirk has now become the target of ridicule. He is doomed.
In the meantime hard left blogger Ellen Gill has provided a campaign song for Kirk: “The Great Pretender:

Kirk’s exaggerations keep catching up with him. His latest claim, that his campaign was attacked by an Alexi Giannoulias “goon,” appears to have been another act of dissembling and exaggeration:

Finally, Democrats are now wondering about their own man who is running to replace Kirk, Dan Seals. Seal ran against Kirk in 2006 and 2008, and never uncovered any of Kirk’s lies and exaggerations. How did Seals spend tons of cash, and never develop a research capacity to expose Kirk? Seals would have four years of congressional seniority behind him if he had run a competent campaign against Kirk. Seals is now the Democratic candidate in Kirk’s old congressional district for the third time. In Illinois, nothing succeeds. Like failure.

Andy Martin: Mark Kirk was working as an “illegal alien” in London
CHICAGO NEWS CONFERENCE SATURDAY: Illinois anti-corruption crusader Andy Martin charges that Mark Kirk was not eligible to be a full-time worker in London, because his 1982-1983 student visa required him to be a full-time student. Kirk claimed Thursday he was a “teacher” In London. Martin says Kirk was not “teaching” lawfully as he claims, because Kirk’s student visa did not allow him to hold full-time employment. Martin has filed Freedom of Information requests with British authorities to obtain Kirk’s records. Martin demands that Kirk furnish actual proof of his ability to work legally, and any earnings he claims to have received for “teaching” in London in 1982-1983. Andy Martin was the first to disclose that Kirk was a military imposter who had fabricated almost all of his military career.

Martin says that as a full-time student, Kirk could not have been a full-time teacher in London. So how could Kirk have been a “teacher” if he was not legally allowed to work?
“There was no way Mark Kirk was legally ‘teaching’ in London,” Martin says. “As a foreign student, his ability to work was restricted. Common sense tells you that you can’t obtain a student visa to study abroad, and then work full-time. So how was Kirk working? What is left of his ‘teaching career’ claim?
“It would appear that Kirk was an ‘illegal alien’ in London and was probably paid under the table or off the books.
“Mr. Kirk owes us the evidence that (i) he was legally allowed to work in London and (ii) that he paid UK taxes on his earnings.
“As always, the issue is Mark Kirk’s personality disorder that forces him to inflate and exaggerate. Kirk is an intelligent man. But he is a deeply flawed individual with an obvious personality disorder that compels him to fib about every aspect of his life.
“Kirk fibs about his military service, he fibs about his work history, and he fibs about his personal orientation and family. I don’t think most psychologists or psychiatrists would have a problem diagnosing a personality disorder in Mr. Kirk. He didn’t just ‘misremember’ one act on one occasion, or even on several occasions such as Richard Blumenthal did. Kirk has persistently lied about every aspect of his life and done so habitually over the decades.
“In seeking to deflect the New York Times’ story about his imaginary ‘teaching’ career, and his casual references to kindergarteners carrying firearms in congressional remarks, Kirk neglected to realize that one lie would lead to another: what kind of visa did he have that allowed him to work in London?
“How can Kirk be a credible candidate for federal office if he is afraid to be interviewed by the New York Times?
“We have launched inquiries with British authorities to obtain information about Kirk’s visa and his work permission in 1982-1983,” Martin will state. “Mr. Kirk could make all of this easier if he simply turned over any evidence he has to support his claim that he was working legally in London.
“Or he can simply admit that he lied, and that he is a pathological and habitual liar that needs therapy.
“I am committed to seeking the truth and the facts, and only the truth and facts, about Mr. Kirk. He is trying just as hard to conceal who he is and what he is.”

I am writing to request an investigation of Mark Kirk by your offices and, if necessary, prosecution and disciplinary action against Mr. Kirk.
For the past decade Mark Kirk has been using the U. S. Navy as a political prop. (I have examples of his literature, and you can find them cached on the Internet.) He has used all of his “deployments” (as he calls them) to pose for pictures in Navy flight suits and flack jackets, which then appear on his political websites. Among his many media lies, he told the Chicago Sun-Times he was fired on by enemy forces while attached to a Dutch unit. He has claimed to have “fought in two wars.” He has claimed to have “deployed” to Afghanistan in 2008 and again in 2009, and after returning he has given “reports” to people who were invited to hear him because of his status as a political candidate, most recently at the Union League Club in Chicago in January.
Kirk has also “tweeted” from the Pentagon, claimed to be running an intelligence operation at the Pentagon and claimed to have won awards/medals that are nonexistent or exaggerated.
Although the media have not yet begun to investigate Kirk’s claim that he was “detailed” to the CIA, I have filed new FOIA requests to verify his “CIA” claims. Please ensure that these FOIA requests are not obstructed or nullified by any ongoing cover-up or corruption.
During the entire period of Kirk’s shenanigans the Navy did nothing to shut down his misbehavior.
Last year I filed Freedom of Information (“FOIA”) requests against Kirk with DOD, USN, USAF, USMC. The Navy provided a single sheet of paper in response. The Air Force refused to disclose if Kirk had traveled on congressional passes to Afghanistan and provided nothing. There was a complete stonewall, and a complete cover-up, from, end to end.
Earlier this week comments apparently originating in the OASD (PA) indicated Kirk had been warned in 2009 about engaging in politics on Navy time. Kirk has denied those accusations and admonitions. His brazenness is unlimited. As such, his lack of an apology makes him an unrepentant sham and thief of Navy valor. When someone refuses to apologize for breaking the law, the law must take even sterner and stronger steps to prosecute such an individual.
Your offices must investigate how the uniformed services, especially the Navy, and DOD were all conned by this military mountebank, and how and why a stonewall of silence was imposed when I sought to access Kirk’s records pursuant to FOIA. The very purpose of the FOIA statute was corrupted and perverted to shield Kirk. Why? Why is DOD violating FOIA when President Obama has asked for more disclosure, not less?
Kirk’s travel accommodations and records, for example, were hardly secret or privileged. The Pentagon has offices which routinely engage in congressional liaison and keep records of their contacts and actions with senators and representatives. Why were those records not turned over to me under FOIA? There was corruption, and there was a cover-up.
I would like those records now.
Was it because of fear of congressional retaliation by Kirk, or fear of embarrassment to the Navy that triggered the cover-up/stonewall? Your offices need to find out. Why was only one sheet of FOIA paper was provided in 2009? The Department of Defense was utterly and completely compromised and corrupted.
Kirk should be drummed out of the service for his egregious misconduct spanning at least a decade.
Kirk also appears to have corrupted the “efficiency report” process. Kirk’s defense this week to allegations that he was admonished is that there is nothing to confirm those admonishments in his ER’s. Why not? Did his reviewing officers know he had been admonished in preparing his ER’s? Or was ER fraud a small part of the larger overall cover-up? You need to find out.
I question whether military officers should be preparing ER’s on senators and representatives. The conflict of interest is obvious and unavoidable. Maybe we also need legislation.
I am sure your offices have experienced prosecutors and investigators. You know where you have to go to look into Kirk's antics, and you know why. Kirk has stained the Navy, stained DOD and embarrassed the entire Pentagon, all in a time of war when brave men and women are in harm's way every day.
Kirk is perhaps the greatest military imposter since Senator Joe McCarthy who campaigned for office as “Tail Gunner Joe” even though he never had been a “tail gunner.” McCarthy was a complete fraud, and so is Mark Kirk.
It has never been my privilege to serve on active duty in uniform. But I have been alongside men who have. I have seen them die. I know the risks men and women take every day. I know how lives are endangered and lost. The idea that a congressional clown could appropriate the valor of our heroes for his own crass political prospects is sickening.
You need to act decisively not only because Kirk broke the law and should be prosecuted, but as a warning to other thieves and frauds who engage in similar misconduct. Hang Kirk out as an example to others who may be tempted to engage in stolen valor and military fraud. And do so decisively and promptly.
I am happy to meet with you in Washington or Arlington if my presence will be of any assistance. My worldwide audience and the American people are waiting for your response.

Dear Major Cunningham:
As you are probably aware, remarks you made to one of my fellow bloggers about Navy officer Mark Kirk have been widely carried by the Associated Press as well as other bloggers.
This letter is a two-part request: first, I would like copies of any materials in your office, OASD (PA), on which your statements to nitpicker.blogspot.com were based. Second, pursuant to FOIA I would like to request all of Mark Kirk’s DOD records within the Navy, Air Force, USMC and elsewhere. All of these records are obviously subject to the FOIA jurisdiction of the Secretary of Defense.
Indeed, in view of the growing congressional and political scandal over Mr. Kirk’s unlawful behavior, I believe Secretary Gates himself should be involved in ordering a “clean breast” and full disclosure of all of Kirk’s files. There has obviously been a cover-up in the past.
My contemporaneous complaint to the DOD IG and USN JAG are self-explanatory.
1. FOIA release of the documents on which your remarks to nitpicker.blogspot.com was based
When you apparently spoke to nitpicker.blogspot.com, I assume (i) you were authorized to do so and (ii) you based your own comments on documents in your possession. Pursuant to FOIA I would like to request copies of all of the Kirk documents on which your nitpicker comments were based, or any other Kirk records in the possession of OASD (PA). At a minimum, if you discussed documents, or if your discussion was based on Kirk documents, there was a FOIA waiver as to any materials which you used in your public dissemination.
2. General Mark Kirk FOIA request - renewed
Lat year, I submitted detailed FOIA requests to DOD, USN, USMC and USAF. Except for one page from USN, I was unlawfully stonewalled. Since then the controversy has exploded. The time for stonewalling is obviously over. Due to the national scandal over Kirk’s misbehavior, the OASD (PA) is obviously the place to coordinate release of FOIA materials.
I am therefore renewing my 2009 and 2010 FOIA requests through this letter.
I filed a FOIA request earlier this month renewing my 2009 requests, as well as a new FOIA request for any of what Mark Kirk claims are his “detailed to the CIA” materials if any exist (Kirk claims the Navy “detailed him to the CIA”).
The Kirk Pentagon fraud and cover-up scandal has become the most egregious example of military fraud in over a half century. The public’s interest in full disclosure now completely overrides any privacy interests which Kirk may have had. He has been exposed as a liar and fraud. The cover-up, and Kirk’s use of military secrecy to defraud the public, must end.
Pursuant to FOIA I am formally and legally requesting, and I would like DOD, USN, USAF to release, any and all records in their possession concerning Mr. Kirk or, in the alternative, to prepare and provide a detailed and explicit “Vaughn Index” for any information which is not disclosed.
For example (1), there have to be records on how Mr. Kirk got to Afghanistan in December, 2009 and again 2009. Did he travel on a USAF congressional plane? Navy plane? There is no basis on which to conceal these records any longer. They are absolutely subject to full FOIA disclosure.
For example (2), were there prior complaints about Kirk? When and where? Were there admonishments, or internal memos within DOD? We need full disclosure and documentation of any discussions of Kirk’s politically suspect behavior. Information concerning violations of laws and regulations is not subject to secrecy under any interpretation of FOIA.
Full disclosure is particularly important because earlier this week, in response to your own disclosures, Kirk denied he had been admonished and said his ER’s were “clean.” Why were his ER’s clean? Is there is a major military/congressional scandal here? I think so. Was the Navy “scrubbing” Kirk’s files because he was a congressman? Because of fear of retaliation? For example (3), a Navy officer “tipped off” Kirk when media filed earlier FOIAs. Is that type of “head’s up” usual under FOIA, or just a “congressional privilege?” Was there a memo on the head’s up? Please turn it over.
You full cooperation, and the full cooperation of DOD and Secretary Gates, will be sincerely appreciated. I only want the truth and the facts about Mark Kirk. Nothing less, and nothing more.

An investigation is essential.

(CHICAGO)(June 13, 2010) Mark Kirk is becoming the biggest political catastrophe in Illinois political history. Bigger than the Jack Ryan meltdown in 2004. Bigger than Adlai Stevenson’s collapse in 1986. But, unlike Ryan’s fall from grace, Kirk’s implosion is unfolding in slow motion. Why?
Kirk’s demise is a slow-motion video because the local media are so heavily invested in Kirk. During the February primary, media effectively “locked out” other candidates and covered only Kirk. The local media bias and moral corruption was despicable. WLS' "Don and Roma," for example, invited only Kirk on the air. Constantly. Now Don and Roma look like the jerks they really are. Even Channel 7, which provided a debate for senate candidates, used the debate to attack the one candidate running truthful ads exposing Kirk’s maladies (yours truly).
Republican Party leaders were bribed with $50,000 of Kirk's cash. Sleazy Kirk stooge Pat Brady defended Kirk from the truth.
The truth about Kirk was too toxic for media to report and too devastating for Republicans to believe in February.
Now the truth about Kirk is now becoming lethal to Kirk himself.
On Thursday, the Chicago Sun-Times picked up a story from a blog which contained actual Department of Defense documents exposing Kirk for misusing his military uniform to conduct “partisan activity.” Those documents are the proverbial “smoking gun.” I will be surprised if the documents do not become a devastating ad. They are documents convicting Kirk. DOD documents.
Scooped by the Sun-Times, the Tribune is firing back today with a major story that Kirk’s “deployments,” which he brazenly trumpeted for years, were all imaginary. The Pentagon does not consider weekend warriors “deployed” when they activate briefly for training periods:

Of course, none of this “news” is “new.” I disclosed all of it in what I called “Bunker Buster” ads in January. But politicians and reporters thought they could get away with perpetrating the biggest fraud in political history: Mark Kirk as the “great warrior.” They pretended not to hear my ads or see my documents. Instead, their primary election reporting parroted Kirk’s “misremembrances.”
Now the same media are destroying Kirk. Republicans are holding back, but not for long.

Finally, the war in Afghanistan is not going well. I will have more to say about that in later columns. As a candidate, I opposed the expansion in Afghanistan. I knew what was coming. Unlike Kirk, I had actually been in harm's way in Afghanistan. I have the experience Kirk only dreams about.
Republicans, with Kirk at the front of the parade, were enthusiastic cheerleaders for the misadventure in Afghanistan. He has not even begun to pay the price for that bad judgment.
When the public finally wakes up and realizes what a disaster Afghanistan has become, Kirk and Obama will ride into the sunset together.
“Veterans” have just begun to mobilize against Kirk. Kirk’s supporters are slowly slipping away, silently in the night. Their own campaigns are endangered by any visible backing for Kirk. Kirk is a disgrace. Ordinary, rank-and-file Republicans are slowly realizing their colossal error in nominating Kirk.
“Don’t ask, don’t tell” may be the prevailing “Republican Party” wisdom about the Kirkster today. But the Decatur Republican headquarters’ missing sign is a telling indication of what Illinois republicans have in their future. It ain’t pretty.

(NEW YORK) (June 10, 2010) New York: Andy Martin explained today at a New York news conference the significance and back story to the latest “explosion” in the Mark Kirk military fraud scandal
The Chicago Sun-Times carries a story Thursday about Department of Defense (“DOD”) accusations on December 9, 2009 that Kirk had unlawfully engaged in “partisan political activities.” That accusation was triggered by materials Andy Martin submitted to DOD on August 1, 2009 as part of his Freedom of Information Act filings at DOD. In other words, Martin's complaints to DOD about Kirk’s unlawful activities triggered an investigation that culminated in the Undersecretary’s accusations against Kirk contained in DOD’s December 9, 2009 letter.
Andy Martin continues to be the driving force behind forcing Mark Kirk out of politics. Andy had not previously released his original August 1, 2009 complaints/FOIA demands to DOD which triggered Kirk’s problems with DOD. Andy Martin told a Palm Beach news conference today he has asked the CIA, Department of Defense and Navy Department to release any files which corroborate Mark Kirk’s claims that Kirk was “detailed” to the CIA. Martin has filed formal Freedom of Information Act (“FOIA”) requests with the agencies.

“The Sun-Times has picked up Department of Defense (“DOD”) documents from the web site www.Nitpicker.blogspot.com,” Martin says. “But no one knew of my clandestine activity behind the scenes until today.
“Why did the Deputy Undersecretary of Defense accuse Mark Kirk of illegal ‘partisan political activities’ while in uniform? It was because of my earlier complaints to DOD, and the accusations I made against Kirk in my FOIA (“Freedom of Information Act”) activity. I will post these documents separately before my New York news conference Thursday.
“I made my initial FOIA request to Secretary of Defense Robert Gates on August 1st. Likewise, I sent Mark Kirk a letter on August 1st asking him to waive his rights under the Privacy Act. He refused. But Kirk knew as early as August 1, 2009 that I was seeking his military records. Between August 1, 2009 and today’s date I have engaged in spirited correspondence with DOD.
“DOD Undersecretary Gail McGinn was obviously aware of my efforts to secure the release of Kirk’s records. I had been tipped off that there was unhappiness within the Pentagon at Kirk’s grandstanding, and was advised to file a FOIA request, which I did.
“Thus, Undersecretary’s McGinn’s accusations of unlawful ‘partisan political activities’ in uniform was triggered by my ongoing comments to DOD
“Mr. Kirk’s statement Wednesday night implicitly acknowledges that within his campaign I am seen as the devil that will not let go. Kirk is obsessed with me. Kirk’s own statement Wednesday evening mentions my radio ads, as he did when he falsely claimed at the Union League Club he had been ‘fighting for [Andy Martin’s] freedom’ in Afghanistan. Kirk knows I have been hounding DOD to tell the truth. I have also filed a DADT complaint against Kirk with the Navy.
“It is unseemly that Kirk now claims his ‘private’ records have been compromised, when he used DOD secrecy to conceal his own criminal activity. Using federal property for political activity is a criminal act. Instead of filing his own FOIA complaint, Kirk should grant the waiver I asked for and direct the release of all of his military records. Kirk has been using federal secrecy laws to cover up his fraudulent activity in uniform.
“The reason the Sun-Times story and the Nitpicker blog entry appear out of context in so far as Undersecretary Gail McGinn’s accusations of unlawful partisan activity by Kirk (all political activity in uniform is unlawful) of December 9, 2009 is because prior to today (June 10th) no one in the media or public knew I had been clandestinely orchestrating DOD investigations against Kirk since August 1, 2009.
“I am usually known as a man who is pretty quick with a news release. But because I was aware of the explosive nature of the DOD allegations against Kirk, I did not issue a news release on August 1st. I planned to use my information about Kirk’s military fraud in campaign advertising. So we kept the FOIA activity embargoed. I held the ‘military imposter’ story until I began running radio ads exposing Kirk as a military fraud in January, 2010. Palm Beach news conference today: Political columnist and reformer Andy Martin is asking the Central Intelligence Agency to release Congressman Mark Kirk’s “CIA file.” The controversial congressman who has been caught in a myriad of lies about his background has claimed to have been “detailed to the CIA.” Martin is asking the CIA to release Kirk’s records, if any exist. CONCERNING CONGRESSMAN MARK KIRK
1. FOIA Request
Mark Kirk has recently been exposed as the greatest military intelligence fibber of all time. See, e.g.:

Kirk also claims he was “detailed to the CIA”:

I have no idea whether Kirk was/is telling the truth about his detailing to the CIA. “Detail” to me means assigned in some form or fashion. While any substantive intelligence Kirk may have acted on may be privileged, or subject to a “Vaughn” Index, the fact of Kirk’s activity in conjunction with the CIA is not privileged. There should be a substantial paper trail if Kirk was in fact “detailed.”
In view of Kirk’s other lies and defalcations, I ask the CIA to immediately disclose any documentation for Kirk’s claims that he was “detailed to the CIA.”
In addition, any contacts Kirk or his congressional office may have had with the CIA are also not privileged.
I respectfully request full FOIA compliance and disclosure and a detailed Vaughn Index for any claims of non-disclosure.
2. Time is of the essence
Time is obviously of the essence. I would therefore ask that the agency proceed expeditiously with this matter.

By this letter, I am responding to you as well as resubmitting my original FOIA request last year to the Chief of Naval Operations, USAF, CMC and U. S. Central Command per our earlier correspondence.
Mark Kirk has recently become the biggest liar in American military history. It is time for the Navy Department, DOD and USAF to stop the cover-up and concealment of Kirk’s records and provide ALL of Kirk's service records.
In particular, Kirk has claimed he was “detailed to the CIA” (see attached). I would like you to release all of Kirk’s CIA file that reflects “detailing” from the navy to the CIA, if any, as well as any and all Kirk files that were previously denied disclosure and withheld in 2009.
THE KIRK SCANDAL IS A MAJOR EMBARRASSMENT TO DOD AND IT IS NOT GOING AWAY.
KIRK HAS BEEN MASQUERADING FOR YEARS AND DOD DID NOTHING TO STOP HIS SHENANIGANS
Last year you tried to obstruct my FOIA requests. Recently, Navy people have also “warned” Kirk the media were seeking FOIA access to his records.
Do you have fax numbers or e-mail addresses for the Navy Department, USAF, CMS and CENTCOM? If so, I would appreciate it if you would provide them to me so I may expedite my request to those subdivisions of DOD with a fax or e-mail.
Here are my responses to the specific questions you previously provided:
1. Scope of Search – CIA vs. DOD vs. CNO vs. USAF vs. CMC vs. CENTCOM
While your DOD search may be limited to nine years, the CNO and Marine Corps FOIA searches would have to extend to the time Mr. Kirk has served in the Navy, or approximately 20 years. Unlike the USAF, CENTCOM or DOD, Navy/CMC records clearly go back further to his original date of service.
Your letter did not mention any offices which are run by DOD for congressional liaison. Does your research include a search of these records as well?
2. Cost of FOIA searches (all agencies listed above)
a. Request for FOIA cost waiver
Mr. Kirk is a candidate for United states Senator. He has prominently and repeatedly claimed his military service as a basis for his election. He has repeatedly staged brief periods of “activation” and used these “activations” to promote his political activity.
Last week Kirk was involved in a political fracas (in which I had no role and only learned about from the media, but whose disclosure is clearly encompassed within my FOIA request) for abusing secrecy at the Pentagon, apparently during another “activation.” I believe a public interest FOIA waiver is therefore fully applicable to any search costs at any and all of the above agencies.
b. Agreement to pay costs
Your request that I agree to an amount in advance that I am willing to pay to obtain FOIA access contradicts my understanding of how FOIA works. My understanding, based on decades of my own FOIA litigation and searches, is that you provide a preliminary estimate of the cost of the file search, and I can then elect to proceed. By asking me what I can afford to pay in advance, you are essentially putting the cart before the horse.
We are dealing here with important public records concerning a candidate for the U. S. Senate, who claims to be the "only congressman mobilized in harm's way since World war II." Therefore, the Navy Department, USAF, Marine Corps, CENTCOM and DOD have de facto become a part of Kirk’s campaign by virtue of his actions, not mine.
I do not expect the FOIA costs to be significant, because the records cannot be that voluminous. Moreover, DOD and its sub-agencies are known for keeping good files on congressional liaison, so the information I seek is clearly encompassed in some master or easily retrievable location(s). I don’t expect you to have to search very hard or very long for files on a sitting congressman who has constantly interfaced with DOD and the additional agencies listed above as recently as last week.
Let’s not be disingenuous about this FOIA request.
Please provide preliminary estimates of the cost. This is directed at all of the above agencies.
3. Presidential directive
My understanding is that President Obama has tasked all executive departments, including CNO, USAF, Marine Corps, CENTCOM and DOD with expansive, expeditious and good faith compliance with FOIA. My request is fully compliant with the President’s directive.
4. Time is of the essence
Time is obviously of the essence. I would therefore ask that all of the above agencies proceed expeditiously with this matter.
